Terms of service

1. Definitions

Customer/consumer: The natural person who is not acting in the course of a profession or business and enters into an agreement with the entrepreneur.

Entrepreneur: The legal entity or natural person who offers products and/or services via the webshop https://homeyst.com/.

Distance agreement: An agreement whereby, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, use is made of one or more means of distance communication.

Cooling-off period: The period during which the consumer can exercise their right of withdrawal.

Right of withdrawal: The possibility for the consumer to withdraw from the distance agreement within the cooling-off period.

Day: Calendar day.

Continuing performance contract: A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

Durable data carrier: Any means by which the consumer or entrepreneur can store information that is addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.

3. Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer.

If the agreement is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically.

Situations not covered by these general terms and conditions will be assessed ‘in the spirit’ of these general terms and conditions.

 

4. The offer

If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated.

The offer contains a complete and accurate description of the products and/or services offered.

Obvious mistakes or errors in the offer are not binding on the entrepreneur.

All images and specifications in the offer are indicative and cannot give rise to compensation or termination of the agreement.

 

5. The agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically.

The entrepreneur takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.

 

6. Right of withdrawal

The consumer has the right to withdraw from the agreement within 14 days of receiving the order without giving any reason.

During the cooling-off period, the consumer must handle the product and packaging with care. If they exercise their right of withdrawal, they must return the product in its original condition and packaging.

The costs of return shipping are borne by the consumer, unless otherwise stated.

Exceptions to the right of withdrawal:

Products that are custom-made or personalized.
Products that are labeled as final sale. 

 

7. Prices and payment

All prices on the website are in euros and include VAT, unless stated otherwise.

Any import duties and customs charges are at the expense of the consumer.

The consumer is obliged to immediately report any inaccuracies in the payment details provided or stated to the entrepreneur.

The following payment methods are accepted:

  • Credit card ( Visa, Mastercard, Maestro, American Express, Union Pay, Discover, Diners Club)
  • Shop Pay
  • Apple Pay
  • Google Pay
  • PayPal

 

8. Delivery and execution

The entrepreneur will take the greatest possible care in receiving and executing orders for products.

The delivery time is 9-10 working days after processing the order.

If delivery is delayed, the consumer will be informed as soon as possible.

 

9. Warranty and conformity

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, and legal requirements.

If the product does not comply with the agreement, the consumer must report this within 7 days of discovery.

The warranty expires if:

  • The consumer has repaired the product themselves or had it repaired.
  • There has been improper use.

 

10. Complaints procedure

Complaints about the performance of the agreement must be submitted to the entrepreneur within 7 days of discovery, fully and clearly described.

The entrepreneur aims to respond to the complaint within 14 days of receiving it.

If a complaint cannot be resolved by mutual agreement, the dispute will be governed by the laws of the United Kingdom.

 

11. Liability

The entrepreneur is not liable for any direct, indirect, incidental, or consequential damage resulting from the use or inability to use the website and products offered.

The entrepreneur is not responsible for delays caused by third parties, such as courier services.

In the event of force majeure, the entrepreneur has the right to suspend delivery or terminate the agreement without being liable for compensation.

 

12. Applicable law

All agreements and disputes between consumers and the entrepreneur are governed by the law of the United Kingdom, without prejudice to any mandatory consumer protection rights under the law of the consumer’s country of residence.
Disputes may be submitted to a competent court in the United Kingdom.
